This Privacy Policy ("Policy") explains how Education Management Solutions ("EMS", "we", "us", or "our") collects, uses, and discloses information from and about users of our applications, including EMS360 ("Applications", "Services").
Collection of personal information
The type of information that EMS collects and holds includes (but is not limited to) personal information, including sensitive information about:
Students
Staff
Parents and/or guardians ("Parents")
Types of information EMS360 collects
EMS360 may collect the following information:
Personal identifiable information: email addresses, first names, and last names
Addresses of schools and/or facilities
User submitted content: reviews, training records, performance evaluations, professional development and/or qualifications
Data storage
EMS360 is hosted on Oracle Cloud Infrastructure (OCI) in data centres that reside physically in Australia. This means that your data is at all times secured and processed exclusively in Australia. In addition EMS360 utilises industry standard encryption methods and algorithms to ensure your data is secure from malicious actors. Use of personal information provided
The primary purpose of collection of personal information is to enable EMS360 to deliver and improve our services to meet your needs and/or requirements as a user.
An individual's access to personal data is restricted by security protocols established within our Applications to their own information or information relating to individuals within the provisions established by a school's administrator
Personal information collected by EMS will be used and disclosed only for the purpose for which it was provided or a directly related secondary purpose, unless agreed otherwise, or where the use or disclosure of that personal information is allowed or required by law.
Disclosure of personal information
EMS will not share personal information held about an individual with any third-party services except in the following instances:
The disclosure is to our service providers who store or process data on our behalf, such as our cloud infrastructure provider, Oracle Cloud Infrastructure (OCI), an enterprise-grade provider with data centres located in Australia, and who are contractually required to protect the information.
The disclosure is required or authorised by or under law; or
The disclosure is reasonably necessary for the enforcement of the criminal law; or
We have reasonable grounds to determine that the disclosure is necessary to prevent or lessen a serious and imminent threat to the life or health of the individual or another individual.
Checking and updating personal information held by EMS
Under the Commonwealth Privacy Act, an individual has the right to obtain access to any personal information which EMS holds about them and to advise of any perceived inaccuracy. There are some exceptions to this right, set out in the Act.
Individuals with personal data on EMS360 and who are approved by the school administrator of EMS360, may have access to their own personal data and in some cases to other individuals with whom the school administrator has associated them in EMS360. The Australian Privacy Principles require EMS to store personal information no longer than necessary.
6. Matters relating to use of EMS360
Access to information collected
EMS does not attempt to identify individual users or their browsing activities through our web server logs except as required for the operation and security of our Applications. However, in the event of an investigation, a law enforcement agency or other government agency may exercise its legal authority to inspect EMS web server logs.
Use of information collected
Your email address and mobile phone number will only be used for the purposes of which it has been provided to us by the school or the individual. They will be used to help facilitate the operations of EMS360, but you may opt out at any time via settings within EMS360 or by contacting support.
Cookies
EMS360 may at times utilise cookies to aid in the ease of using the Applications.
You can manually disable cookies at any time. Simply check your web browser’s “Help” function to find out how to disable cookies in your web browser. Disabling cookies will not impact your ability to access EMS360 or its Applications.
Under the Commonwealth Privacy Act, an individual has the right to obtain access to any personal information which EMS holds about them and to advise of any perceived inaccuracy. There are some exceptions to this right, set out in the Act.
7. Complaints
If any person believes that we may have breached their privacy they may contact us to make a complaint using the contact details below. In order to ensure that we fully understand the nature of any complaint and the outcome they may be seeking, we prefer that all privacy complaints are made in writing.
EMS undertakes to assess and resolve all privacy complaints diligently and in a timely manner.

Reporting privacy breaches
If you suspect a privacy breach involving your information, please contact us immediately.

Your consent
By using our software, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy. Schools are responsible for ensuring they have authority (including, where required, parental or guardian consent) to provide student and staff information to EMS.
Changes to this privacy policy
We may update this policy from time to time to reflect changes in our practices or comply with legal requirements. We will post the revised policy on our website and encourage you to review it periodically.
